This policy describes the information that should be present in a DMCA Notice and a DMCA Counter-Notice.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the "Strawberry Spinach Salad With Candied" service by completing a DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

Upon receipt of a valid DMCA Notice, "Strawberry Spinach Salad With Candied" will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the service.

Please include the following information in your DMCA Notice:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you believe has been infringed or, if the claim involves multiple works on the service, a representative list of such works.
  3. Identification of the material that you claim is infringing and where it is located on the "Strawberry Spinach Salad With Candied" service. Please provide reasonably sufficient information to permit "Strawberry Spinach Salad With Candied" to locate the material (e.g., URL(s) of the material).
  4. Your contact information, including your address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Filing a DMCA Counter-Notification

If you believe that the material you posted on the service was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us (a "Counter-Notice") by submitting written notification to our Designated Copyright Agent. Pursuant to the DMCA, the Counter-Notice must include substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled (e.g., URL(s) of the material).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States, for any judicial district in which "Strawberry Spinach Salad With Candied" may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

The DMCA allows us to restore the removed content if the party filing the original DMCA Notice does not file a court action against you within ten business days of receiving the copy of your Counter-Notice.
